IR35 Contract Review and Working Practices Review
When a contractor is entering into a contract with an agency or directly with the end client, it is essential that they consider whether the written contract and the actual working relationship is outside of IR35.
There are many providers out there now that are able to carry out a review of the contract and the working relationship between the contractor and the end client and also willing to negotiate with the agency and/or end client on your behalf.
The benefit of utilising such a service is to ease the mind and with the assistance of an expert ensure you are working compliantly and outside of IR35. A lot of agencies in particular have relationships with IR35 experts so are willing to listen them during negotiations over the wording of the contract.
Taking out a contract and working practices review will also demonstrate to HMRC, should you be under investigation, that you have taken steps to ensure IR35 best practice.
Once your working practices and written contract are compliant, it is also worth completing a confirmation of arrangements (COA) document.
A COA is a written document that outlines the working relationship between the contractor and the end client with a signature from the contractor and end client to confirm the nature of the working relationship. A COA can also be used as evidence should you be subject to an IR35 investigation, therefore highlighting the importance of the document.
