Does IR35 apply to non-UK residents?

Q. Hi, If I’m planning to start working as an IT contractor for UK based client. I got my LTD company registered already. However, my plan is to work from European countries remotely. Can I still be eligable for IR35 this way?

A. You don’t say where your company is registered but even if this were not in the UK & you, the worker are resident in the UK, & does work for a UK client, then IR35 needs to be considered. Ultimately, however, this will depend on your UK residency status.

If your company is UK registered but you qualify as a non-UK resident & your duties are performed outside the UK, then it is unlikely that the IR35 rules will apply but you should check your residency status by referring to HMRC residency guidance.
