Am I caught by IR35?

Q. I currently am a freelancer / self employed. I carry out work for various individuals but have no set times when i do their work. They say 10 hours a week but i can do those 10 hours as and when i like. Assume i am okay with this?

A. The fact that you have multiple clients & can select the hours you carry out the work are sound pointers towards self-employment as they demonstrate:

  • Being in business on your own account
  • Non-exclusivity, ie you are not compelled to work for just one client
  • Control over your working time
