Q. My question relates to IR35 expenses. My permanent homes address is 150 miles away from my place of work. The only way I could maintain this contract is to go in on Monday and return home on Friday as otherwise I will have to make a 300 miles trip daily by road as I need my car to travel from client to client for work purpose. I work for a Local Authority and caught by IR35. Now my question is this. Should my accommodation expenses for the period be claimable? I know that people employed directly by local authorities can claim for overnight expenses if they travel out of area for work purposes.
A. Although employees can claim for extraordinary expenses where they are required to travel outside of their usual commute, ordinary home to work expenses are not claimable, and therefore in our opinion you would not be able to claim the cost of the accommodation, because the role has been determined to fall inside of IR35.
